Parents' Legal Rights In the Education System

PARENTS LEGAL RIGHTS IN THE EDUCATION SYSTEM Track: Policy, Advocacy and Legislative Issues; Family Perspectives and Support Authors: Alexis Kashar, Esq. and Howard Rosenblum, Esq. Affiliation: 1) The National Association of the Deaf , Washington, D.C. and 2) The New York School for the Deaf, White Plains, N.Y. Presenter: Alexis Kashar, Esq. and Howard Rosenblum, Esq. Parents with deaf children have a nearly two-decade relationship with special education staff and providers in their respective school district. It is important for parents to understand the full range of services available to their deaf or hard of hearing child under federal laws, particularly the Individuals with Disabilities Education Act. The law provides very specific rights for deaf and hard of hearing children including but not limited to: a free and appropriate public education (FAPE), least restrictive environment (LRE), Individualized Education Program (IEP), continuum of placement options, and many other important terms, concepts and rules. Parents need to be fully prepared and familiar with these terms, concepts and rules throughout their deaf or hard of hearing child’s education. Parents also need to understand their ability and right to agree or disagree with the special education team on any proposed program or service on their child’s IEP. This includes the right to challenge educational placements and IEP goals determined by the special education team. As a last resort, parents have the option of filing a due process hearing request to challenge any IEP proposed by the special education team. Participants will leave this presentation with a good grasp of special education rights for deaf and hard of hearing children. Alexis Kashar (Co-Presenter), National Association for the Deaf, aakashar@aol.com;
ALEXIS KASHAR received her B.A. in Finance and her J.D. from the University of Texas at Austin. After receiving her J.D. in 1992, she practiced civil rights and special education law in Los Angeles, California until she relocated to New York. During that time, she represented hundreds of children with special needs in obtaining free and appropriate public education. Ms. Kashar is currently involved with several community boards and activities. Kashar is the president of the Board of Trustees for the New York School for the Deaf. In addition, she chairs the National Association for the Deaf (NAD)'s public policy committee. Ms. Kashar also has presented on laws providing for access for people who are deaf or have disabilities, including the Americans with Disabilities Act (ADA), the Individuals with Disabilities Education Act and the United Nations Convention on the Rights of Persons with Disabilities.

Howard Rosenblum (Co-Presenter), National Association for the Deaf, howard.rosenblum@nad.org;
Howard A. Rosenblum started as the Chief Executive Officer of the NAD in April 2011 and also serves as an ex officio member of the NAD Board of Directors. He comes to the NAD after 19 years as a lawyer, focusing his practice on disability rights and special education law. For the past nine years, he was a Senior Attorney at Equip for Equality, and previously worked ten years as an associate at a private law firm. In 2010, President Barack Obama appointed Mr. Rosenblum to serve on the United States Access Board. Mr. Rosenblum has a bachelor of science degree in computer engineering from the University of Arizona and a juris doctor degree from the Illinois Institute of Technology Chicago-Kent College of Law.
